In the production of cosmetics, knowledge of laws and regulations is essential. Before a product is launched on the market, a comprehensive safety assessment and safety report must be conducted. The safety assessment can be carried out by a qualified industry expert. The documentation of the product's safety report must be stored and readily available for inspection.

The EU Cosmetics Regulation governs the production, packaging, and marketing of cosmetics. In our operations, we pay attention to legislation from the very beginning of the product design phase. Considering the standards from the start facilitates the product's compliance with regulations, both for the Finnish and the EU/EEA markets. Additionally, Finland has its own national cosmetics law, which defines operations at a general level. This includes, for example, who oversees the market activity in Finland, the responsibilities of each party (customers, producers, marketers, and authorities), and what additional guidelines must be followed alongside the EU Cosmetics Regulation.

Here are the key factors you need to consider when manufacturing cosmetics

Cosmetic or Health Product?
First, it’s important to determine the nature of the product—whether it is a cosmetic or a medicinal or health product. If the product is not classified as a cosmetic, its production and marketing may fall under the legislation of another industry. In Finland, cosmetics are regulated by Tukes (the Finnish Safety and Chemicals Agency) and Customs.

Product Composition
Composition is a critical aspect of cosmetic product manufacturing. What ingredients and mixtures does the product contain? Are there any substances planned for inclusion that are restricted or even prohibited under the EU Cosmetics Regulation? Once the list of ingredients is clear, testing can begin to determine the desired concentrations of different substances in the product and how their functionality can be verified.

Cosmetic Safety
Product safety is tested at several stages of the process. Product safety also falls under laws and regulations. The product must be proven safe through adequate physical, chemical, and biological tests. The manufacturer must be aware of any potential side effects related to the product, and all research and experiences related to product safety must be thoroughly documented.

Product Packaging
Packaging labels are important in cosmetics and are regulated by the Cosmetics Regulation. Packaging labels help the customer and end-user to learn about the product in their own language. In Finland, packaging labels must be available in both Finnish and Swedish.

In cosmetics manufacturing, responsibility must be clearly defined for production, marketing, and distribution. All parties must be fully aware of their roles. The roles of responsible individuals are also regulated under cosmetics laws.
